Terms of Service

These Terms of Service ("Terms") are a legal agreement between you ("you," "your," or "User") and Crypto Brains DOO, operating as FinalFrame ("FinalFrame," "we," "us," or "our"). By creating an account or using the FinalFrame service at finalframe.photo (the "Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Service Description and AI Disclaimer
1.1 What FinalFrame Does
FinalFrame is an AI-powered photography critique platform. The Service analyzes photographs you upload and provides structured feedback including scores, tier assessments, editing suggestions, composition analysis, and related commentary. Additional features include image curation (set selection and ranking), iteration tracking (comparing revised versions of the same photograph), progress insights, coaching briefs, photography challenges, and a public gallery.
1.2 AI-Generated Output
All critique, scoring, curation, and feedback provided by FinalFrame is generated by artificial intelligence (currently powered by OpenAI models). You acknowledge and agree that:
- AI-generated critique represents algorithmic opinion, not professional photography advice, expert evaluation, or objective fact.
- Scores, tier assessments (A through C), and suggestions are computational outputs. They do not constitute guarantees of image quality, commercial viability, competition results, or suitability for any particular purpose.
- AI analysis may contain errors, inconsistencies, or subjective judgments that differ from human experts.
- FinalFrame is an educational and creative tool. It is not a substitute for professional photography instruction, portfolio review by a human expert, or any form of professional advice.
- The "Final Frame" designation, "stop editing" recommendations, and similar features are AI suggestions, not definitive assessments.
1.3 AI Transparency
Every analysis, critique, score, curation result, and progress insight you receive through FinalFrame is generated by AI. There is no human review of individual critiques before they are delivered to you. The AI model provider we use is disclosed in our Privacy Policy § 2.6b.
2. Eligibility
You must be at least 16 years of age to use FinalFrame. By creating an account, you represent that you meet this age requirement. If you are between 16 and 18 years old (or the age of majority in your jurisdiction), you represent that a parent or legal guardian has reviewed and agrees to these Terms on your behalf.
If we learn that a User is under 16, we will terminate their account and delete their data promptly.
3. Account Responsibilities
- You must provide a valid email address to create an account. Your email is used for authentication, billing communications, and important service notifications.
- You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
- You must notify us promptly at support@finalframe.photo if you become aware of any unauthorized access to your account.
- You may not share, sell, or transfer your account to another person.
- You may not create multiple accounts to circumvent plan limits, abuse the referral program, or evade enforcement actions.
- Account information (display name, username, bio) that you set must not impersonate another person or entity.
4. Content Ownership
4.1 You Retain All Rights
You retain full copyright and all intellectual property rights to every image you upload to FinalFrame. We do not claim any ownership of your photographs, and nothing in these Terms transfers ownership of your content to us.
4.2 Responsibility for Your Content
You represent and warrant that for each image you upload, you either (a) own the copyright or (b) have obtained all necessary permissions, licenses, or releases from the copyright holder to upload and have the image analyzed by our Service. If your images contain identifiable people, you are responsible for obtaining appropriate consent from those individuals (including model releases where applicable).
5. License Grant to FinalFrame
5.1 Service Delivery License
By uploading content to FinalFrame, you grant us a limited, non-exclusive, revocable, worldwide, royalty-free license to:
- Store your images on our servers and cloud infrastructure for the duration of your account (subject to tier-based retention policies described in Section 13).
- Process your images, including resizing, format conversion, and metadata extraction (EXIF data such as camera model, lens, focal length, aperture, shutter speed, and ISO), solely to deliver the Service.
- Transmit your images to our AI provider (currently OpenAI) for analysis. Images sent to the AI provider are processed under their API data usage policies, which as of the date of these Terms do not use API inputs for model training.
- Generate and store AI-produced critique text, scores, and metadata derived from your images.
- Display processed versions of your images back to you within the Service interface.
5.2 What We Will NOT Do
We will not:
- Use your images to train, fine-tune, or improve any AI or machine learning model.
- Sell, license, or distribute your images to third parties.
- Use your images for marketing, advertising, or promotional purposes without your separate, explicit written consent.
- Perform facial recognition, biometric identification, or biometric data extraction on your images. Our AI analyzes photographic composition, technique, and aesthetics only.
5.3 License Termination
The license granted in Section 5.1 terminates when you delete the relevant content or your account, subject to reasonable technical delays for deletion to propagate through our systems (including backup rotation).
6. Public Gallery
6.1 Opt-In Publishing
The FinalFrame public gallery is entirely opt-in. Your images are private by default. You may choose to publish a project to the gallery, making it visible to anyone who visits the gallery. You may choose to share only your final image ("Final Only") or your full editing journey including all versions ("Full Journey").
6.2 Gallery License
If you publish content to the gallery, you grant us an additional license to publicly display your published images, associated critique data (scores, tier, genre, summary), your display name, and your public profile information on the FinalFrame website and gallery. This additional license is revocable: you can unpublish your content at any time, and we will remove it from the public gallery promptly.
6.3 Gallery Requirements
To publish to the gallery, you must:
- Set a display name in your account settings.
- Have a completed critique on the image you wish to publish.
- Ensure the image passes our content moderation checks (see Section 9).
- If your image contains identifiable persons, ensure you have appropriate consent or model releases as described in Section 4.2.
6.4 Public Profiles
If you set a username and publish images to the gallery, a public photographer profile page will be accessible at your username URL. This profile displays your display name, bio, avatar, published projects, gear information (extracted from EXIF data of published images), and aggregate statistics. You can remove your public profile at any time by unpublishing all gallery content or removing your username.
6.5 Embeddable Badge
If you publish images to the gallery, you may generate an embeddable badge that displays a count of your gallery-published "Final Frame" images and a typical tier, for placement on third-party websites you control (such as a personal blog or portfolio). The badge reflects FinalFrame's automated, AI-generated assessment of your published work; it is an algorithmic opinion as described in Sections 1.2 and 1.3, not a professional accreditation, certification, or guarantee of quality. The badge is served from a cache and updates within approximately one hour; if you unpublish content, or your account is suspended or removed from the gallery, the badge stops displaying your statistics within that window and reverts to a neutral mark. You are responsible for how and where you embed the badge.
7. Share Links
FinalFrame may provide share tokens that generate unique URLs for individual critiques. Anyone with the share link URL can view the critique result and associated image, even without a FinalFrame account. Share links are separate from gallery publishing.
- You are responsible for controlling the distribution of your share links.
- When you share content via a share link, the link remains accessible until you revoke it. Due to image caching by third-party platforms (WhatsApp, Facebook, X), shared images may remain visible in cached previews for up to 7 days after revocation.
- When you revoke a share link or delete a critique, new visitors cannot view the share page and no fresh image URLs are issued. A signed image URL already delivered to a browser remains fetchable for up to 3 hours (shared and public gallery images) or up to 1 hour (private images) before it expires at the storage level. See our Privacy Policy Section 2.10 for further detail.
- Share links remain active as long as the underlying project and critique exist. Deleting a project or your account will invalidate all associated share links.
- We are not responsible for content accessed via share links that you have distributed.
Copyright retention: You retain all copyright and intellectual property rights in your photographs. Sharing via FinalFrame does not transfer ownership.
Model release responsibility: If your shared content includes identifiable persons, you are responsible for obtaining any required consent or model releases.
8. Acceptable Use Policy
You agree not to use FinalFrame to:
- Upload, transmit, or store any content that is illegal, obscene, threatening, defamatory, or that violates the rights of any third party.
- Upload content depicting the exploitation or abuse of minors in any form. Such content will be immediately deleted and the associated account will be permanently suspended. We may cooperate with law enforcement authorities upon lawful request.
- Upload, store, or share intimate, sexual, or nude imagery of any identifiable person without that person's consent (including so-called “revenge pornography” and other non-consensual intimate imagery). Such content will be removed and may result in immediate account suspension.
- Upload images that you do not have the right to use or that infringe any copyright, trademark, or other intellectual property right.
- Upload sexually explicit or NSFW content to the public gallery. Such content will be removed and may result in account suspension.
- Upload AI-generated images (images created by DALL-E, Midjourney, Stable Diffusion, or similar tools) and represent them as photographs. FinalFrame is a platform for real photography. AI-generated images are removed from the public gallery when detected.
- Use automated scripts, bots, scrapers, or other programmatic means to access the Service, submit images, or extract data without our prior written consent.
- Attempt to circumvent plan limits, rate limits, or usage quotas through any means, including creating multiple accounts.
- Abuse the referral program, including self-referrals, creating fake accounts for referral rewards, or any other manipulation of the referral system.
- Interfere with or disrupt the Service, servers, or networks connected to the Service.
- Reverse-engineer, decompile, or attempt to extract the source code or system prompts of the Service.
- Use the Service to develop a competing product or service.
- Resell, sublicense, or commercially redistribute critique results or access to the Service without our written consent.
9. Content Moderation
9.1 Automated Screening
All images uploaded to FinalFrame undergo automated content moderation before or during AI analysis. This may include:
- AI-generated image detection to identify non-photographic content.
- Content safety screening (via OpenAI moderation) to flag potentially harmful or inappropriate content.
- Additional automated checks as we may implement from time to time.
9.2 Moderation Outcomes
Content flagged by our moderation systems may be: (a) blocked from the public gallery while remaining in your private account, (b) removed entirely from the Service, or (c) result in your account being suspended or terminated, depending on the severity and nature of the violation.
9.3 Our Rights
We reserve the right, but have no obligation, to review, monitor, or remove any content at our sole discretion, for any reason or no reason, including content that we believe violates these Terms or is harmful to users, third parties, or the Service.
9.4 Reporting
If you encounter content in the public gallery that you believe violates these Terms, please report it to support@finalframe.photo.
9.5 Severe Violations
The rules in this Section 9.5 apply only to the narrow list of severe categories below. All other moderation decisions (including adult content, graphic violence, self-harm imagery, hateful-content classifications) follow the review-first rules described in Section 9.6 and Section 11.11; your subscription, credits, and uploaded content are preserved while a person reviews the automated decision.
The following categories of content constitute a severe violation and will result in immediate, permanent account suspension:
- Any depiction of minors in a sexual, sexually suggestive, nude, or otherwise exploitative context (including generated, drawn, or rendered imagery of minors: “virtual” does not reduce the violation).
- Child sexual abuse material (CSAM) of any kind, in any form, regardless of claimed age, source, or artistic intent.
- Depictions of sexual activity involving non-human animals (bestiality).
- Content that sexualizes or targets a real identifiable minor, whether produced by photography, editing, or AI generation.
Upon suspension for any of the above: (a) your account will be permanently disabled; (b) any active subscription will be cancelled immediately with no refund for the remaining subscription period; (c) metadata about the violation (timestamp, flagged categories, confidence scores, cryptographic image hash, IP address, user agent) will be retained indefinitely for law enforcement cooperation and platform safety; (d) the flagged content will be deleted immediately and not retained in any form. This section survives termination of these Terms.
How severe violations are detected. The categories listed above are detected through a combination of (i) user and third-party reports submitted under Section 9.4, (ii) automated screening of adult sexual content with admin-review surfacing on borderline scores, and (iii) human review by our team. We do not currently operate a dedicated automated detector for child sexual abuse material on uploaded images; we rely on the reporting pathway in Section 9.4 and the human-review safeguards above. See our Privacy Policy § 2.6 for the technical detail of which content categories are screened automatically.
9.6 False Positives and Reinstatement
Our automated content review systems may occasionally flag images incorrectly, particularly for genres such as fine art nudes, documentary photography, medical or anatomical reference, or photojournalism showing violence in context. If you believe your account was suspended in error, you may request a human review through either of the following paths:
- Suspended account page (preferred). Visit /suspended while signed in. The “Request a review” form includes your reference ID automatically and submits directly to our moderation team.
- Email. Write to support@finalframe.photo with the reference ID displayed on the suspended page. A person on our team will read your message directly and reply typically within 3 business days.
If the review determines the suspension was in error, we will reinstate your account in full. For a non-severe (Section 9.5) suspension, your subscription, credits, uploaded content, and public share links are preserved throughout the review and are restored intact when the decision is overturned; your subscription continues uninterrupted and billing resumes on its original schedule, with no need to resubscribe (see § 11.11). You may need to sign in again. Section 9.5 severe violations (CSAM, sexual content depicting minors, bestiality) are not eligible for reinstatement through this process.
10. Copyright Infringement
10.1 Respect for Copyright
FinalFrame respects the intellectual property rights of others and expects users to do the same. We will respond to notices of alleged copyright infringement that comply with applicable law.
10.2 Filing a Copyright Takedown Notice
If you believe that content available on FinalFrame infringes your copyright, please email us at support@finalframe.photo with the following information:
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing and information sufficient to locate it (e.g., the URL of the gallery page).
- Your contact information, including your name and email address.
- A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
We will investigate all valid notices and take appropriate action, which may include removing the infringing content and notifying the uploader.
10.3 Counter-Notification
If you believe your content was removed in error, you may submit a counter-notification to support@finalframe.photo with: (a) identification of the removed material and its prior location, (b) a statement that you have a good faith belief the material was removed by mistake, and (c) your name and contact information.
10.4 Repeat Infringers
We may, in appropriate circumstances, terminate the accounts of users who are repeat copyright infringers.
11. Payment Terms
11.1 Free Tier
FinalFrame offers a free tier with limited functionality. Free accounts receive 3 critique credits per month plus, once per account, up to 2 bonus credits earned through onboarding actions, added to the month in which they are earned; up to 3 versions per project; and a lifetime total of 1 curation session per account (up to 8 images). Free-tier credits do not carry over. Unused credits, including bonus credits, expire at each monthly reset. No payment information is required for the free tier.
Bonus and promotional credits (including onboarding bonus credits) are granted at our discretion and may be withheld, reduced, or revoked where we detect abuse, circumvention of plan limits, or repeat sign-ups, including via email aliases or re-registration after account deletion.
Where we detect that more than one account has been created at the same email mailbox using address variants (for example dots or plus-tags that deliver to a single inbox), we may also limit or withhold the monthly free credit allowance for the affected accounts. The account remains accessible, and this does not affect paid subscriptions or credits you have purchased.
11.2 Paid Subscriptions
FinalFrame offers the following paid subscription plans:
- Pro: $19/month -- 50 monthly critique credits, up to 1,000 versions per project, curation up to 15 images, access to photography challenges, and additional features as described on our pricing page.
- Premium: $36/month -- 100 monthly critique credits, up to 1,000 versions per project, curation up to 24 images, Coaching Brief feature, and additional features as described on our pricing page.
11.3 Credit System
Paid plans use a monthly credit system. Each critique consumes 1 credit. Critique iterations (a fresh critique of your edited version plus a point-by-point comparison against the previous version) consume 2 credits. “Which Shot?” comparisons (a side-by-side review of two different photographs) consume 3 credits. Curation sessions consume credits based on the number of images (approximately 1 credit per 2 images, rounded up, with a minimum of 2 credits per session). Re-scoring the same set after you upload improved versions of its photos ("Re-evaluate edits") consumes 2 credits; changing which photos are in a set starts a new curation session, priced as above.
- Monthly credits reset at the beginning of each billing period. On paid plans, unused monthly credits roll over to the next billing period, up to a maximum balance of 1.5× your plan's monthly allotment (up to 75 credits on Pro and 150 on Premium). Credits above that cap are forfeited and have no cash value. Purchased credit packs are separate and retain their 12-month expiry.
- When your monthly credits are exhausted, purchased credits (see Section 11.4) are consumed automatically.
- Purchased credit packs pause their 12-month expiry clock during any cancelled or lapsed subscription period. The clock resumes when you reactivate: packs retain their original remaining validity.
11.3a Mid-Cycle Tier Changes
Proration methodology. When you change your plan mid-cycle (for example, upgrading from Pro to Premium, or switching from monthly to annual billing), we charge a pro-rated amount for the remainder of your current billing period. Our payment processor (Paddle, see Section 11.5) calculates it: the unused time on your current plan is credited, and the new plan's price is charged across that same remaining period. Because the calculation is made to the minute and includes any tax applicable at your location, the exact amount is shown to you on the order screen before you place the order, and is itemized on the receipt Paddle sends you. A change that keeps your billing frequency the same does not move your next regular renewal date forward or backward; only the one-time proration charge is taken today.
Non-refundable proration. Pro-rated charges collected at the moment of a mid-cycle tier change are non-refundable once the tier change has been applied to your account and the upgraded entitlement (credits, Coaching Brief, higher per-project limits) has been made available to you. If you change your mind, you can downgrade on the next billing boundary using the billing portal described in Section 11.6; the amount already charged for the current cycle is not returned. Section 11.7 (cancellation and refunds) and Section 11.8 (withdrawal waiver) otherwise continue to apply.
Waiver re-consent on plan changes. When you upgrade to a tier that includes additional digital-content features beyond your current tier (for example, Premium's Coaching Brief on top of Pro), we record your express consent to immediate performance of the new service and your acknowledgment that, per Directive 2011/83/EU Art. 16(m) and the equivalent national transpositions, the 14-day cooling-off right does not apply to the additional entitlements granted by the upgrade. When you change your billing frequency (for example, switching from monthly to annual), we likewise record a fresh express consent and acknowledgment: not because new features are added, but because the change commits you to a new, longer minimum term with an immediate charge, so the waiver you gave when you first subscribed does not extend to it. Each such consent is captured at the order screen for that specific change, separately from the consent you gave when you first subscribed, and a record (action, timestamp, IP address, user agent, from-plan, to-plan, and the amount shown to you) is stored as described in our Privacy Policy Section 2.13a.
Confirmation email. Paddle, as our Merchant of Record, sends the authoritative receipt for the proration charge. We also send you a plan-change confirmation email noting your from-plan, to-plan, and new recurring rate. Paddle's receipt is the authoritative record of the exact one-time proration charge and your next renewal date. That confirmation email also states your billing frequency and how to cancel. These recurring-rate, frequency, and cancellation details are included for every subscriber and are the acknowledgments contemplated by California Business and Professions Code § 17602(a)(8)(C) (as amended by AB 2863, effective July 1, 2025) for a change to an automatically renewing subscription.
11.4 Credit Packs
You may purchase an additional credit pack: 20 credits for $9. Extra credits, meaning credits from a pack together with any other credits granted to you outside your monthly allowance, expire on the date shown on your account. That date is normally 12 months after your most recent credit pack purchase, and each new purchase resets it for your whole extra balance; a referral reward sets it the same way, and some grants carry no expiry at all. Extra credits are consumed only after your monthly subscription credits are exhausted. Extra credits have no cash value and are not currency. They cannot be transferred, gifted, or resold.
11.5 Payment Processing and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Paddle contracts through more than one legal entity, and the Paddle company that is your counterparty is determined by the location you purchase from. We do not reproduce the list of entities here, because it changes when Paddle adds or changes one; the current entities and the rule that selects between them are set out in Paddle's buyer terms, linked below. Paddle is the legal seller; they process your payment, collect applicable taxes (VAT, sales tax, GST), issue invoices, and handle refund requests. FinalFrame does not directly store your credit card number or payment credentials. Your purchase is subject to Paddle's Buyer Terms and Paddle's Privacy Policy. By providing payment information, you authorize Paddle to charge the applicable fees to your payment method.
11.6 Auto-Renewal
A monthly subscription automatically renews each month unless you cancel before the renewal date. An annual subscription does not renew for another year. At the end of the annual period it continues as a monthly subscription at the then-current monthly price for your plan, and you may cancel it at any time from that point on, with effect at the end of the month then running. You will be charged the then-current subscription price at each renewal. You may cancel auto-renewal at any time through the billing portal accessible from your account settings. The product, the amount and frequency of the recurring charge, and how to cancel are disclosed to you at checkout and remain available at any time in the billing portal. Paddle, as our Merchant of Record, also sends reminder notices about your subscription where required by law in your territory of purchase. You authorize Paddle to charge the applicable fees at each renewal until you cancel.
You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period with no pro-rated charge, and no cancellation fee applies.
11.7 Cancellation and Refunds
As explained in Section 11.5, Paddle is the Merchant of Record for every FinalFrame transaction. Paddle is the legal seller and the refund counterparty of record: the money movement, the tax record, and the applicable per-jurisdiction consumer-law obligations sit with Paddle, not with FinalFrame. The refund terms below are FinalFrame's statement of the policy that applies to your purchases; where your local law grants you a broader right, that law prevails and Paddle administers it. Paddle's Refund Policy governs the procedure and any country-specific variations.
Cancellation. You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of your current billing period; you retain access to paid features until the end of the period you have already paid for, after which your account reverts to the Free tier. Cancellation is not a refund; it stops the next renewal. Unused monthly credits are not carried into the Free tier and are not refunded, including any balance that rolled over under Section 11.3. Your extra credits, meaning any credit balance other than your current monthly allowance however it reached your account, remain yours. Their expiry clock pauses while you have no paid plan, and on the Free tier you can spend them on critiques and iterations; Section 11.4 describes how they work. There is no cancellation fee and no pro-rated charge.
Refunds. Except where a mandatory consumer-protection law gives you a refund right, all payments are non-refundable. Your principal statutory right, and how it applies to FinalFrame's digital content, is set out in Section 11.8 (Right of Withdrawal):
- If you are a consumer in the EU, EEA, Switzerland, or the United Kingdom, you have a statutory right to withdraw from your purchase and receive a full refund within 14 days of the transaction. Consumers in some other countries have a shorter statutory cancellation window (for example, 7 days in South Korea, Brazil, and Canada; 5 days in Singapore); Paddle applies the window set by your jurisdiction.
- This withdrawal right does not apply to digital content that has started to be used, once you have given your express consent to immediate access and acknowledged the loss of the right, as described in Section 11.8. For FinalFrame, a subscription or credit pack starts to be used, and the right falls away, when you first spend a credit from it. Until then the withdrawal right remains available to you for the rest of the 14-day window, and Paddle administers it.
- Refunds are not issued where there is evidence of fraud, refund abuse, or other manipulative behaviour (see Section 11.12).
- Where a refund is due, Paddle processes it to your original payment method within 14 days of approving the request.
How to request a refund. Use the refund link on your Paddle receipt, request it from your Paddle customer portal at my.paddle.com, or contact Paddle support. A refund request addressed to FinalFrame at support@finalframe.photo is forwarded to Paddle for processing.
What happens when a refund is issued. If a full refund is issued on an active subscription, your account reverts to the Free plan as soon as the refund is processed; there is no continued access for the remainder of the period that was refunded. If a refund is issued on a credit pack, the refunded amount is deducted from your remaining purchased-credit balance, floored at zero; credits already spent on critiques or iterations are not reversed, and those outputs remain in your gallery. In every case, your past critiques, iterations, and galleries stay intact.
When you cancel, we ask an optional reason to help us improve the product. See our Privacy Policy Section 2.13 for how this data is used and retained.
11.7a Resubscription After a Gap
You may resubscribe to a paid plan at any time after a cancellation. Your previous critique history, progress data, and generated outputs remain in your account during the gap. Monthly credit allowances begin fresh on the day you resubscribe: prior unused monthly credits are not restored. Purchased credit packs pause their 12-month expiry clock during the gap and resume on reactivation (see §11.3). The withdrawal terms in §11.8 apply to resubscriptions on the same basis as new subscriptions. Pause is not a gap; resubscription rules apply only after cancellation, not after pause (see §11.14).
11.8 Right of Withdrawal
A FinalFrame purchase gives you access to digital content and to digital services. When you buy a subscription or a credit pack, you are asked at the order screen to request immediate access and to acknowledge how that affects your 14-day right of withdrawal under EU Directive 2011/83/EU (and equivalent local consumer protection laws).
Your credits are available immediately, but your withdrawal right does not end at that moment. It ends when you first spend a credit from the purchase, as stated in Section 11.7. Until then you may withdraw for the remainder of the 14-day window, and Paddle administers the request.
If you withdraw after you have begun to use the purchase, you pay an amount in proportion to what you have already used, measured against the full cover of the contract, and Paddle refunds the balance. We calculate that proportion from the credits you have spent against the credits the purchase provided.
11.9 Price Changes
We reserve the right to change subscription prices. For existing subscribers, price changes will take effect at the start of the next billing period following at least 30 days' notice. If you do not agree with a price change, you may cancel your subscription before the new price takes effect. Section 12.3 sets out the reasons for which we may change a price, how we notify you, and what we refund if you terminate; it applies to price changes in full.
11.10 Failed Payments and Plan Reversion
If a subscription payment fails, Paddle will retry the charge over approximately 30 days following the default retry schedule. During this retry window, we will send you up to three operational emails (first notice, midpoint reminder, and final notice) and display an in-app banner prompting you to update your payment method. Monthly credit refills are paused during the retry window: credits you have already received remain available to spend, but no new refills are issued until payment succeeds. If all retries fail within the retry window, your paid plan reverts to Free and you retain access to any galleries, critiques, and previously generated outputs. These dunning notifications are part of our service contract with you and cannot be disabled by marketing-email preferences. We may also send a courtesy notice up to 14 days before your payment card expires so you can update it in advance. Refund and chargeback rules under §11.7 apply unchanged; this section only describes unpaid renewal mechanics.
11.11 Billing During a Moderation Review
If your account is paused for an automated content-moderation review that is not a Section 9.5 severe-category violation (for example, an adult-content, graphic-violence, self-harm imagery, or hateful-content classification), your subscription, remaining credits, and account data are preserved while a person on our team reviews the decision. During the review:
- We do not cancel your subscription and we do not delete your photos or critiques. Your paid plan and its credit allowance remain attached to your account.
- You cannot use the Service while the review is open. This is an operational pause, not a termination.
- If a human review upholds the block, your subscription ends at the close of your current paid billing period and you will not be charged again. You will not be charged a pro-rated cancellation fee, and you will not receive a refund for time that had already elapsed when the review started.
- If a human review overturns the automated decision, your account is fully restored, your subscription continues uninterrupted, and billing resumes on its original schedule.
- Payments made for service time that you were unable to use during the review period are not automatically refunded. If we overturn the decision and you believe a goodwill refund is appropriate, contact support@finalframe.photo; any such refund is processed by Paddle under its Refund Policy.
This section does not apply to Section 9.5 severe violations. For those, the subscription is cancelled immediately with no refund and no reinstatement path.
11.12 Refund Abuse
We reserve the right to decline future refund requests, restrict credit-pack purchases, or terminate accounts that exhibit a pattern of refund abuse (including repeated refunds after substantial consumption of credits, repeated chargebacks, or coordinated refund requests across multiple accounts). Legitimate disputes about billing errors, duplicate charges, or failure-to-deliver are never treated as abuse.
11.13 Administrator Access
Accounts with administrative privileges over the Service are protected by a time-based one-time password (TOTP) second factor in addition to email-and-password authentication. Reinstatement of an account suspended under §9.5 (severe-category violations) requires written approval from FinalFrame's designated legal advisor. We may strengthen these controls (including hardware-key authentication and per-session re-authentication for destructive actions) over time and will update this section when such controls are in effect.
11.14 Subscription Pause
- Pause is a service modification, not a refund or cancellation. Pausing temporarily suspends access and billing for the pause period. Paid time you have already purchased is not forfeited.
- Pause duration: 1 month. Pause automatically ends 1 month after the effective start date.
- Pause frequency: 1 per rolling 6 months. You may pause your subscription once every 6 months.
- No refund during pause. Pausing does not refund prior payments. Per §11.8 (right of withdrawal), the 14-day withdrawal period ended when you first spent a credit from the purchase, and pausing does not restart it.
- Auto-resume. Billing resumes automatically on the pause-end date at the then-current price. Your projects, critique history, and account data remain intact during pause.
- Cancellation during pause. You may cancel your subscription at any time during a pause via /account. Cancellation ends the subscription at the natural billing-period boundary (which has been deferred by the pause duration). No refund is owed for banked-but-unused portions.
12. Plan Limits and Changes
12.1 Current Plan Limits
Each plan has defined usage limits, including: critiques per period, versions per project, curation session limits, curation image limits, and access to specific features (challenges, coaching briefs, progress insights). Current limits are displayed on our pricing page and in your account dashboard.
12.2 Burst Limits
To ensure service stability and fair use, all accounts (including paid accounts) are subject to short-term rate limits. These prevent excessive usage within brief time windows and are separate from your plan's credit allocation.
12.3 Changes to Plans and Limits
We may change a plan's price, its monthly credit allowance, the credit cost of an action, or any other plan limit. We will only do so for a valid reason, and the notice we send you will say which reason applies. Those reasons are: a material change in the cost or the capability of the third-party AI models and infrastructure the Service depends on; a change in tax or regulatory requirements that applies to the Service; or the addition of features to the plan. We will tell you by email, at the address on your account, at least 30 days before the change takes effect. We may also show an in-app notice, but that never replaces the email. You may terminate your subscription at any time before the change takes effect, at no cost. If you terminate and you have already paid in advance for a period that has not yet run, including an annual subscription or a credit pack, we refund the unused remainder of that payment pro rata: the part of the term that would have remained had you not terminated. That refund is owed whether or not Section 11.7 would otherwise provide one.
13. Data Retention by Tier
13.1 Free Tier
Free accounts have a 30-day active history window. Projects older than 30 days are "archived"; they are frozen and no longer editable or viewable in full, but are not permanently deleted. If you upgrade to a paid plan, archived projects become accessible again.
13.2 Paid Tiers (Pro and Premium)
Paid accounts have full access to their complete project history for as long as their subscription is active. If your subscription expires or is cancelled, your account reverts to free tier retention policies after your paid period ends.
13.3 Account Deletion
When you delete your account (see Section 18), all your data is permanently deleted, including: your profile, all projects, all image files, all critiques, all curation sessions, progress insights, referral records, and any other data associated with your account. This deletion cascades through all related records and cannot be undone. Image files are removed from cloud storage, and database records are deleted via cascading foreign key constraints. A narrow set of records is retained after deletion where the law requires or permits it (for example billing ledger entries, moderation metadata, and consent records); these are listed in our Privacy Policy Section 7.4.
13.4 Backup Retention
Deleted data may persist in encrypted system backups until it ages out of our database provider's automated backup rotation; on our current plan, daily backups remain available for 7 days. Backups are not accessible to you or used for any purpose other than disaster recovery.
14. AI-Generated Content Disclaimer
14.1 No Professional Advice
AI-generated critique, scores, editing suggestions, progress narratives, coaching briefs, and all other AI outputs from FinalFrame are provided for informational and educational purposes only. They do not constitute professional photography instruction, art direction, or any form of professional advice.
14.2 No Guarantee of Accuracy
AI outputs may be inaccurate, inconsistent between sessions, or subjectively misaligned with your creative vision or the assessment of human experts. Scores may vary for similar images. Editing suggestions may not produce the described results. We make no representations or warranties regarding the accuracy, reliability, or completeness of any AI-generated output.
14.3 Your Creative Judgment
You are solely responsible for any creative, business, or professional decisions you make based on FinalFrame's AI output. We are not liable for any consequences of following or relying on AI-generated suggestions, including but not limited to: competition outcomes, portfolio decisions, print orders, client deliveries, or any other use of your photographs.
14.4 Third-Party AI Providers
FinalFrame uses third-party AI services (currently OpenAI) to generate analysis. We do not control these providers' models, training data, or outputs. We are not responsible for changes to third-party AI model behavior that may affect the quality, consistency, or nature of critique output.
15. Limitation of Liability
15.1 Service Provided "As Is"
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
15.2 No Guarantee of Availability
We do not guarantee that the Service will be uninterrupted, error-free, secure, or available at any particular time. We may modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice.
15.3 Liability Cap
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FINALFRAME'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL FEES YOU PAID TO FINALFRAME IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50.00).
15.4 Exclusion of Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FINALFRAME BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, REPUTATION, OR GOODWILL, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF FINALFRAME HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
15.5 Exceptions
Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud, gross negligence, willful misconduct, or death or personal injury caused by negligence.
16. Indemnification
You agree to indemnify, defend, and hold harmless FinalFrame, its owner(s), affiliates, officers, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the Service or any activity under your account.
- Content you upload, including any claims that your content infringes the intellectual property, privacy, publicity, or other rights of any third party.
- Your violation of these Terms or any applicable law.
- Any dispute between you and a third party relating to content you published to the gallery or shared via share links.
17. Dispute Resolution
17.1 Informal Resolution
Before initiating any formal dispute resolution, you agree to first contact us at support@finalframe.photo and attempt to resolve the dispute informally for at least 30 days.
17.2 Mediation
If informal resolution fails, either party may propose mediation before a mutually agreed mediator. Mediation costs shall be shared equally between the parties.
17.3 Jurisdiction
If mediation is unsuccessful or if either party elects not to mediate, the dispute shall be submitted to the competent courts as specified in the Governing Law section below.
18. Termination and Account Deletion
18.1 Termination by You
You may delete your account at any time from your account settings. If you have an active paid subscription, it will be automatically canceled upon account deletion. No further charges will be made. Account deletion is permanent and irreversible.
18.2 Termination by Us
We may suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to: violation of these Terms, abusive behavior, fraud, or activity harmful to other Users or the Service. In cases of suspected illegal activity, we may cooperate with law enforcement authorities upon lawful request. For severe content violations (Section 9.5), termination is immediate and permanent with no refund for the remaining subscription period.
18.3 Effect of Termination
Upon account termination or deletion:
- All your images, projects, critiques, curation sessions, and associated data will be permanently deleted, except the limited records described in our Privacy Policy Section 7.4.
- Any content you published to the public gallery will be removed.
- All share links will become invalid.
- Unused monthly credits and purchased credits are forfeited. No refund is provided for unused credits upon termination.
- Referral rewards already granted to you or others based on your referrals are not affected.
18.4 Survival
Sections 4 (Content Ownership), 5.2 (What We Will Not Do), 9.5 (Severe Violations), 14 (AI-Generated Content Disclaimer), 15 (Limitation of Liability), 16 (Indemnification), 17 (Dispute Resolution), and 21 (Governing Law) survive termination of these Terms.
19. Modification of Terms
19.1 Right to Modify
We may update these Terms from time to time. When we make changes, we will update the "Last updated" date at the top of this page.
19.2 Notice of Material Changes
For material changes that affect your rights or obligations, we will provide at least 30 days' advance notice via email to the address associated with your account. We may also show a notice within the Service, but that never replaces the email. Material changes include modifications to: payment terms, subscription prices, plan credit allowances and per-action credit costs, license grants, limitation of liability, dispute resolution, or data retention policies.
19.3 Acceptance
Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the changes. If you do not agree with the updated Terms, you must stop using the Service and delete your account before the changes take effect.
20. General Provisions
20.1 Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
20.2 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and FinalFrame regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
20.3 Assignment
You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of all or substantially all of our assets, without your consent but with reasonable notice to you.
20.4 Waiver
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. A waiver of any provision is effective only if in writing and signed by us.
20.5 Force Majeure
We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to: natural disasters, acts of government, internet disruptions, third-party service outages (including AI provider outages or API changes), cyberattacks, or pandemics.
20.6 Referral Program
FinalFrame offers a referral program where both the referrer and the referred user receive 5 bonus critique credits upon the referred user's first critique. These credits are added to your extra-credit balance and expire as described in Section 11.4. The referral program is subject to the following rules: (a) each user is limited to 25 referrals, (b) self-referrals are prohibited and will not be rewarded, (c) we reserve the right to modify, suspend, or terminate the referral program at any time, and (d) abuse of the referral program (including creating fake accounts) may result in forfeiture of referral rewards and account termination.
21. Governing Law
These Terms shall be governed by and construed in accordance with the substantive laws of the Republic of Serbia. Any disputes arising from these Terms that are not resolved through informal resolution or mediation shall be submitted to the competent courts in Šabac, Serbia.
If you are a consumer (a natural person acting for purposes outside your trade, business, craft or profession), this choice of law does not deprive you of the protection afforded to you by provisions that cannot be derogated from by agreement under the law of the country where you are habitually resident, and nothing in these Terms affects any right you have to bring proceedings in the courts of that country.
